The new indictment takes into account the Supreme Court’s presidential immunity ruling.
Special Counsel Jack Smith brought another indictment of former President Donald Trump before a new grand jury regarding the events of January 6 at the Capitol and actions taken to investigate the 2020 presidential election.
The special counsel’s office stated, “The superseding indictment, which was presented to a new grand jury that had not previously heard evidence in this case, reflects the Government’s efforts to respect and implement the Supreme Court’s holdings and remand instructions.”
The special counsel is reworking the case in light of the Supreme Court’s decision, released July 1, on the immunity of presidents for official acts. Chief Justice Roberts wrote in the ruling, “The system of separated powers designed by the Framers has always demanded an energetic, independent Executive.” He added that former presidents “may not be prosecuted“ for carrying out their constitutional duties.
